Terms of Use and License Agreement for Kaleidoscope Curriculum

Susan O’Halloran has the exclusive copyrights to the Kaleidoscope:Valuing Differences and Creating Inclusion (Levels One and Two) curriculum, which includes written or hard copy lesson plans and Kaleidoscope Voices, Level One and Level Two Discussion Videotapes. The curriculum and videos contains professional training tools that are the work product of Susan O’Halloran to assist educators in presenting diversity materials in classroom settings.

Unless otherwise specified, the curriculum and videos are for non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the curriculum, except as defined herein.

Copyright
The sale of the curriculum and videos does not constitute a transfer of copyright interests in any manner.

Terms of Use
Use of the curriculum and videos is governed by the terms of the end user license agreement, if any, which accompanies or is included with the curriculum ("License Agreement"). An end user will be unable to purchase, unless he or she first agrees to the License Agreement terms.

Limited Rights to Reproduction and Distribution
Any reproduction or redistribution of the curriculum or the videos not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE CURRICULUM (HARD COPY OR DISK) IS LIMITED TO A TOTAL OF FIVE (5) COPIES FOR USE WITHIN A SINGLE ORGANIZATION OR SINGLE SCHOOL ENTITY. FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED, UNLESS ADDITIONAL USER LICENSES ARE PURCHASED. THIS REPRODUCTION DOES NOT INCLUDE THE LEVEL ONE AND LEVEL TWO DISCUSSION VIDEOS. THE VIDEOS MAY NEVER BE COPIED OR REPRODUCED.

Warranty
SUSAN O’HALLORAN HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE CURRICULUM, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
FOR YOUR CONVENIENCE, SUSAN O’HALLORAN MAY MAKE AVAILABLE AS PART OF THE SERVICES OR IN ITS CURRICULUM PRODUCTS, TOOLS AND UTILITIES FOR USE AND/OR DOWNLOAD. SUSAN O’HALLORAN DOES NOT MAKE ANY ASSURANCES WITH REGARD TO THE ACCURACY OF THE RESULTS OR OUTPUT THAT DERIVES FROM SUCH USE OF ANY SUCH TOOLS AND UTILITIES. PLEASE RESPECT THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS WHEN USING THE TOOLS AND UTILITIES MADE AVAILABLE ON THE WEBSITE.

Prohibited Acts

You are strictly prohibited from:

a) Selling or duplicating the curriculum to other organizations or schools outside of your organization or school entity.

b) Selling or duplicating the curriculum to any other outside agency.

c) Using the curriculum in a workshop or other setting, attended by those outside of your organization or school entity.

d) Creating more than 5 copies of the hard copy curriculum without purchasing additional user licenses.

e) Public exhibition for a fee or no fee without written authorization from Susan O’Halloran.

f) Copying or reproducing the discussion videos.

Additional User Licenses

Since the user license is limited to a total of (5) five copies, additional user licenses may be purchased from our website by visiting http://www.susanohalloran.com or by calling us at toll-free 1-866-997-8726. Additional videotapes may also be purchased.

Penalties for Violations of Copyright or User License

Should the educational institution violate the copyright or user license, the purchaser will be liable for all damages arising from copyright infringement, pursuant to 17 U.S.C. Section 501 et. seq. including disgorgement of profits, statutory damages, attorneys fees, costs and criminal indictment. The educational institution purchaser, through its Agent acknowledges the copyright interests of Susan O’Halloran and agrees to all the terms and conditions set forth herein above.
